Competition Rules

PUMA Promotional Competition

  1. This PUMA promotional competition (“Competition”) is run by Pharmacare Ltd t/a Aspen Pharmacare (“Promoter”) and is open to all entrants who are private persons, of 18 years or older and a citizen or permanent resident of South Africa, except the employees and their immediate families of the Promoter, its advertising and promotion agencies, associated companies, and outlet owners and staff.
  2. The Promoter reserves the right, at its reasonable sole discretion and election, to alter, amend and/or cancel this Competition (including, but not limited to, the mechanics, value and/or prize) in its entirety. In the event of an amendment, alteration and/or cancellation, the Promoter will not compensate any individual for any reason whatsoever. These Rules and any amendments, alterations or cancellations will be at the instance of, and interpreted by, the Promoter only.
  3. Proof of South African citizenship and age may need to be provided in the form of either a valid South African identity document or driver’s license.
  4. These Competition Rules and any related notifications will be published on www.pumacough.co.za as well as the promotional leaflet found in participating Spaza shops, wholesalers and independent pharmacies.
  5. Participation by all entrants (“Participants”) constitutes acceptance of these Competition Rules.
  6. Competition Period: The Competition begins on 25 April 2023 and ends on 25 October 2023.
  7. Prize/s: The Prize consists of prepaid airtime vouchers loaded with R100 airtime (one hundred Rand). 20 (twenty) Vouchers loaded with R100 airtime will be awarded every month for 6 months. Only 1 prize will be awarded per winner and no person may win more than once in this Competition.
  8. Entry (and cost if any): To ensure a valid entry, Participants must: take a selfie in front of (and including) the PUMA Spaza shop branding boards at the entrance of participating Spaza shops, or take a selfie with the competition leaflet found in participating Spaza shops, wholesalers and independent pharmacies, and WhatsApp the selfie, along with your name and surname to the competition WhatsApp line: 078 228 6284. You may enter as many times as you like.
  9. Draw and draw date/s: The Prize winners (“Winners”) will be selected by a random monthly draw of those consumers who have taken a selfie of themselves in front of the PUMA Spaza shop branding boards at the entrance of participating Spaza shops, or with the competition leaflet found in participating Spaza shops, wholesalers and independent pharmacies, and sent it with their details to the competition WhatsApp line detailed in rule no 8. The draws will take place on the 26th of each month, commencing May 26th and concluding on November 26th 2023.
  10. Winner/s Notification: Winners will be notified via WhatsApp message from the competition line by the 5th of each month of the competition period. Should the winner not respond to the WhatsApp message, the competition organisers will also call winners on their mobile number provided when entering the competition. If after 3 days of WhatsApp messages and call attempts to notify winners of their win, the winners have not responded to confirm their identity, an alternative winner will be drawn.
  11. Prize Redemption: The airtime will be sent directly to the winners’ mobile numbers and can be used at the winners’ discretion.
  12. The Promoter’s decision, with regards to all aspects of this Competition is final and no discussions or correspondence will be entered into.
  13. The Prize is not transferrable, exchangeable for cash or for an alternate prize.
  14. The Promoter may make media announcements / publications of the names /photographs of Winners and/or Participants however any Winner or Participant may expressly choose to decline this. Winners or Participants will not receive any payment or other remuneration and all publicity and other materials will be the sole property of the Promoter. When winners are contacted a consent form will be supplied by the competition organisers, which winners will need to fill out to indicate if they consent to the use of their images for campaign promotional purposes or not.
  15. Entries must be the original work of the Participant/s. The Promoter may disqualify entries and/or refuse to award the Prize/s to Participant/s and/or Winner/s if the work/entry was published previously (in any form), infringes the copyright or any other rights of any third party, there is suspicion of plagiarism, any irregularities or fraudulent activities. Any liability arising as a result of infringements will be that of the Participant and not the Promoter.
  16. Participants agree that the Promoter will have the right to use, copy, reproduce, reasonably modify, adapt, publish, translate, create collective or derivative works from, distribute, perform and display their entry in whole or in part and to incorporate it in other works in any form, media, or technology now known or later developed with no compensation therefore to the Participant/s. The origin of the work will be appropriately attributed.
  17. The Promoter is however, under no obligation to any Participant or Winner to utilise any part of his/her Entry/submission.
  18. Participants are prohibited from submitting an entry that is in the reasonable discretion of the Promoter unlawful, obscene, pornographic, libellous, defamatory, threatening, or other material that would violate any law, code of ethics, regulation or code of responsible advertising, or may be considered as generally irresponsible in relation to the pharmaceutical industry or anything that may compromise the Promoter’s reputation or legal position.
  19. The Promoter accepts no responsibility for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
  20. The Promoter will not be liable for technical, hardware, or software failures of any kind or for lost or unavailable network connections which may limit or prohibit a Participant’s ability to participate in the Competition.
  21. The Promoter reserves the right to carry out audits in respect of the Winner to verify their eligibility.
  22. All Participants and Winner/s indemnify the Promoter, its associated companies (directors, officers and employees) and agents, against any / all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever from their participation in any way howsoever in this Competition.
  23. Each Participant, by participating in the Competition, acknowledges, agrees, and expressly consents to having the Promoter and the organizer collect, store, process and use (not share) Personal Information for purposes of performing this Competition, communication and/or statistical purposes. In this regard the Aspen Privacy Statement published on the Aspen website (www.aspenpharma.com ) explains how Aspen collects, shares and uses personal data of data subjects in its interactions, and how a data subject may exercise her/his data privacy rights. 
  24. The processing of the Personal Information will take place in accordance with the provisions of the Protection of Personal Information Act 14 of 2013(“POPIA”) and any other applicable law, and for the purpose of giving effect to the Competition. The Participant has the right to request any corrections or deletions of their Personal Information. The Participant may contact the Prompter via the details provided on the Aspen Privacy Statement published on the Aspen website (www.aspenpharma.com). 
  25. This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook.
